Legal Requirements
Farmers intending to process seed outside of their own holding and for their own use are obliged by law to:
a) ensure the identity of the seed throughout processing.
b) ensure that the processor has been registered with the Plant Variety Development Office CLG (PVDO). Please contact us for a list of registered processors.
c) obtain an undertaking from the processor that measures are being taken to ensure the identity of the seed throughout processing.
d) pay royalties due on own seed subsequently sown.
It is illegal:
- To falsify a return
- Not to declare farm/home saved seed used
- Not to declare farm/home saved seed used even if not processed or dressed
- To trade, sell or barter in farm/home saved seed
Offenders are being prosecuted.
Please note if you dress your own Farm Saved Seed with a registered plant protection product / chemical you are required to register as a processor with PVDO. Contact us to complete this simple process.
A seed processor can only process your seed on your own holding or at their registered premises.
PVDO is responsible for the registration of seed processors and monitoring their compliance with legislation. Processors provide a record of processing activities and samples of dressed seed to PVDO. We do not oversee the calibration of machinery and you should ensure you are satisfied with product application and cleaning services provided.
